Kim Ki Jung and Lee Yong Dae sanctioned by BWF for ‘whereabouts’ violations

The Badminton World Federation (BWF) issued a press release today that may clarify what has become hot news on the Korea sporting scene today. The BWF revealed that men’s doubles stars Lee Yong Dae and Kim Ki Jung had violated “the requirements relating to filing whereabouts information and resulting missed tests under the BWF Anti-Doping Regulations (Section 2.4)”.

The two players apparently answered the charges on January 13th, the day before the Malaysia Open Superseries Premier event began, at a three-member BWF Doping Hearing Panel.

As part of Badminton World Federation’s (BWF) Registered Testing Pool of International Level badminton athletes, Kim and Lee were required to provide whereabouts information for the BWF to conduct out-of-competition testing. In 2013, both athletes accumulated three (3) whereabouts failures in connection with this administrative process.

Lee and Kim, who are currently members of the 2nd- and 5th-ranked men’s doubles pairs in the world, will be ineligible from January 23rd, 2014, to midnight on January 23rd, 2015, “during which time the players cannot participate in any capacity in a competition or activity as defined under Section 10.10.1 of the BWF Anti-Doping Regulations – Status during Ineligibility”.

The normal sanction period of two years was not applied in this case because the BWF panel determined that the failure of the Badminton Korea Association (BKA) “on behalf of the players, to make diligent efforts to keep the BWF informed about the players’ whereabouts” constituted extenuating circumstances. These may also result in the BKA being fined by the BWF.

The period of ineligibility means that the two players will be ineligible for as many as four major badminton events to be hosted in Korea in the coming 12 months, including the 2014 Incheon Asian Games, in addition to the BWF World Championships and the Thomas Cup.

'Whereabouts' Sanction for Koreans

Korean badminton players, Kim Ki Jung and Lee Yong Dae, have each received a one-year sanction for violating the requirements relating to filing whereabouts information and resulting missed tests under the BWF Anti-Doping Regulations (Section 2.4).

Their period of ineligibility is from 23 January 2014 to midnight on 23 January 2015, during which time the players cannot participate in any capacity in a competition or activity as defined under Section 10.10.1 of the BWF Anti-Doping Regulations – Status during Ineligibility.

As part of Badminton World Federation’s (BWF) Registered Testing Pool of International Level badminton athletes, Kim and Lee were required to provide whereabouts information for the BWF to conduct out-of-competition testing. In 2013, both athletes accumulated three (3) whereabouts failures in connection with this administrative process. The Koreans appeared before a three-member BWF Doping Hearing Panel on Monday 13 January, 2014, to answer these charges.

The panel concluded there were extenuating circumstances to only sanction the players for one (1) year of ineligibility (as opposed to the maximum two years) due to the Badminton Korea Association’s failure, on behalf of the players, to make diligent efforts to keep the BWF informed about the players’ whereabouts. Due to such lack of diligent efforts, the panel has recommended that the BWF should fine Badminton Korea Association (BWF Anti-Doping Regulation 12.1 and 12.2.3). Given this recommendation, the BWF has initiated a process to decide on any additional disciplinary sanction against the Badminton Korea Association.

Kim and Lee have the right to appeal (Clause 13.2.1 of BWF Anti-Doping Regulations) to the Court of Arbitration for Sport (CAS) in Switzerland, at latest midnight KL time on 17 February, 2014.

Kalau di Singapore biasanya di kirim ke India.
Di ASEAN cuman Thailand yg punya lab khusus anti doping.

Seoul - Dua pebulutangkis top Korea Selatan Lee Yong-dae dan Kim Ki-jung terancam absen di Asian Games tahun ini. Mereka diganjar larangan tampil selama satu tahun oleh Federasi Bulutangkis Dunia (BWF) karena gagal mengikut tes doping.

"Pebulutangkis Korea Kim Ki-jung dan Lee Yong-dae masing-masing menerima sanksi satu tahun karena melanggar persyaratan terkait pengajuan informasi keberadaan dan hasil tidak hadir pada tes doping di bawah Regulasi Antidoping BWF," sebut BWF yang dikutip Reuters.

"Kim dan Lee diminta untuk menginformasikan keberadaan kepada BWF untuk uji kompetisi. Pada 2013, kedua atlet sudah tiga kali tidak hadir memenuhi proses administrasi ini. "

Hukuman itu berlaku efektif hingga 23 Januari 2015. Namun, federasi bulutangkis Korsel menilai hukuman itu tak adil. Merekapun berencana membawa kasus itu kepada Badan Arbitrase Olahraga.

Maklum, mereka berstatus sebagai tuan rumah pada Asian Games yang bergulir 19 September-4 Oktober di Incheon. Tanpa keduanya, barisan pelatih harus putar otak mengutak-atik pasangan baru lagi.

Yong-dae dan Ki-jung tak lagi berpasangan di nomor ganda putra. Yong Dae mulai stabil tampil bersama Ko Sung Hyun dan ada di urutan kedua dunia sedangkan Kim J un di posisi kelima dunia berpasangan dengan Kim Sa-Rang.

"Saat petugas WADA berkunjung ke Taeneung Training Center Maret dan November tahun lalu, Lee dan Kim memang tidak ada di tempat. Mereka sedang mengikuti turnamen lokal dan internasional," kata Direktur Eksekutif Federasi Bulutangkis Korsel, Kim Jung-so.
Kami gagal menyampaikan laporan keberadaan secara online September lalu. Kim dan Lee tidak pernah menggunakan zat yang dilarang dan tidak menolak atau sengaja menghindari tes itu. Mereka telah berpartisipasi dalam sejumlah kompetisi internasional dan selalu lulus semua tes," sambung Jung-so.

“Sulit untuk mengerti jika mereka mendapatkan hukuman hanya karena tidak hadir saat petugas datang untuk mengecek keberadaan mereka tanpa pemberitahuan lebih dahulu,” keluh dia.

Kim menambahkan federasi akan ngotot untuk meminta keringanan hukuman. Setidaknya sanksi hanya berlaku tiga sampai enam bulan.

Yong Dae Stops Training and Hires a Lawyer

Lee Yong Dae is ready to fight the decision of the BWF. According to local daily The Dong-A Ilbo, the case of Korean legend and his compatriot Kim Ki Jung – who have been handed a one-year suspension for ‘whereabouts’ violations – has been taken up by top Korean law firm Kim&Jang, with a task force headed up by Amercian lawyer Jeffrey Jones. Jones, who served 5 terms as head of the U.S. Chamber of Commerce in Korea, was already a celebrity in Korea even before he represented football player Park Jong-woo, who had his bronze medal taken away at the London Olympics for making a political statement.

The Koreans have already said they would be appealing the BWF sanction before the Court of Arbitration for Sport (CAS) in Switzerland. They have until Feb 17 to file the appeal.

At this moment, both Lee Yong Dae and Kim Ki Jung are not training at the national training centre and Lee Yong Dae has asked not to train, for the time being, with his pro team Samsung Electromechanics, which is also home to Kim Ki Jung and his partner Kim Sa Rang. Lee is instead staying at home in his apartment and is not in contact with Samsung, the national team, or the Badminton Korea Association.

The current one-year ban that has been imposed by the BWF will prevent the two players from playing in the Asian Games in Incheon this coming September. For Kim Ki Jung, this could be his last chance to obtain an exemption from military service, which he would get by winning gold in Incheon.
